Warranty Information

By using your ASUSTOR Inc ("ASUSTOR") product, you agree to be bound by the terms of the ASUSTOR Limited Warranty ("Warranty") below. This Warranty is incorporated into and forms part of the Terms of Sale. All capitalized terms used in this Warranty without definition will have the same meanings set forth in the Terms of Sale. If you do not agree to the terms of the Warranty, please return the Product within the return period

Definitions

  1. Out-of-Warranty RMA Service shall mean product fails to function and needs to have a repair service beyond the warranty period (counted from the date printed on the invoice).
  2. Under-Warranty RMA Service shall mean product fails to function and need to have a repair service beyond one (1) month from the date printed on the invoice, and under Warranty period (counted from the date printed on the invoice).
  3. DOA shall mean product completely fails to function within one (1) month from the date printed on the invoice.

Limited Warranty

ASUSTOR Inc. guarantees its products free from defects in material and workmanship under normal use. This period ranges from three months to five years effective from the date of purchase and each product’s specific warranty period can be found on the product’s specifications page or the product support page. The duration of an ASUSTOR product’s Warranty shall be clearly displayed on its product page. Subject to the conditions and limitations set forth below, ASUSTOR will, at its option, either repair or replace any part of its products that are proven defective by reason of improper workmanship or materials. An extra Warranty period may be provided by ASUSTOR’s worldwide dealers/distributors at their discretion. Please contact your dealer or distributor for information on their Warranty terms and conditions. An extended Warranty may be offered in exchange for extra payment in some jurisdictions.
All ASUSTOR products come without hard drives or SSDs. ASUSTOR does not provide support or a Warranty for hard drives or SSDs installed on its devices. ASUSTOR does not guarantee compatibility for third party devices installed into a NAS, including, but not limited to hard drives, SSDs, and external peripherals. ASUSTOR will not be held liable in any way for the loss of data stored on ASUSTOR products and damage caused by hardware and software malfunction.
In the event that a product is found to be defective by reason of improper workmanship or materials within the Warranty period, ASUSTOR will, at its discretion, repair the defective product or replace the item with an item of equal or greater value. Items returned to ASUSTOR for replacement automatically become the property of ASUSTOR. Replacement products may either be new or reconditioned.
This Warranty is void if:

  1. The Warranty period has ended.
  2. The serial number label is missing or unrecognizable.
  3. The product was subject to abuse or improper use that does not conform to product manual instructions, or environment conditions more severe than those specified in the manual and specifications.
  4. The product was subject to Force Majeure, including, but not limited to acts of God, floods, lightning, earthquakes, war, vandalism, theft, brownouts or sags (damage due to low voltage disturbances).

If a customer's product is not covered under this Warranty, ASUSTOR may offer repair services to the customer, subject to a fee.
Additional Notes:
Unless prohibited by law, customers are responsible for the shipping of returned items to ASUSTOR. Shipments must contain a tracking number.

Repair Services and Your Rights

In-Warranty and out-of-Warranty repair services should be obtained by first contacting the place of purchase, be that the system integrator, dealer, retailer, online retailer or distributor. When requesting service, proof of purchase and product serial number must be provided. Returns of defective products should be done strictly through the original route of purchase and the product shall be packaged appropriately to prevent damage to the product during transportation.
ASUSTOR is committed towards the concept of right to repair. Third-party repairs or modifications within the Warranty period do not void your product’s Warranty, however, third-party repairs are not covered by ASUSTOR’s Warranty. ASUSTOR cannot honor Warranties for products damaged by third-party repair or modification, but ASUSTOR continues to honor Warranties for defects in material or workmanship unrelated to third party repair, modification, or software. Defects in workmanship or materials deemed the responsibility of ASUSTOR shall be accepted for Warranty within the Warranty period. ASUSTOR is not able to provide technical support for actions that run the device out of specification, including, but not limited to third party operating systems, third party software and apps, replacement of components beyond specifications. Support requests for unsupported software or hardware will be rejected.
ASUSTOR recommends first contacting the dealer of purchase for in-Warranty services. If the original channel is no longer in business or otherwise unavailable, the customer may contact ASUSTOR Technical Support for international RMA services. In this case, the customer may be  responsible for handling fees and all fees incurred, including, but not limited to two way freight, duties, taxes and brokerage fees.
It is a customer's sole responsibility to properly back up their data. Before allowing any type of service from ASUSTOR or its service providers, including remote login check and repairing services, the customer must back up all data and remove any confidential, proprietary or personal information. Neither ASUSTOR nor its service providers will be held liable for any damage or loss due to exposure of confidential or private information or data contained in any product, hardware, software or media.
For Australian consumers: The rights described in this Warranty are in addition to the statutory rights to which you may be entitled under the Competition and Consumer Act 2010 and other applicable Australian consumer protection laws and regulations. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Repair of the goods may result in loss of data. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.
For EU Consumers: Residents of the European Union are governed by EU consumer law.
For Canadian Consumers: Residents of Quebec are governed by that province's consumer protection legislation.
For US Consumers: Your rights are governed by the Magnuson-Moss Warranty Act

DISCLAIMER OF WARRANTY

WARRANTIES EXCLUSIVE

IF AN ASUSTOR PRODUCT DOES NOT OPERATE AS GUARANTEED ABOVE, THE CUSTOMER'S SOLE REMEDY SHALL BE, AT ASUSTOR'S OPTION, REPAIR OR REPLACEMENT. THE FOREGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ASUSTOR NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH THE SALE, INSTALLATION MAINTENANCE OR USE OF ASUSTOR PRODUCTS.

ASUSTOR SHALL NOT BE HELD LIABLE UNDER THIS WARRANTY IF ITS TESTING AND EXAMINATION DISCLOSE THAT THE ALLEGED DEFECT IN THE PRODUCT DOES NOT EXIST OR WAS CAUSED BY CUSTOMER'S OR THIRD PARTY'S MISUSE, NEGLECT, IMPROPER INSTALLATION OR TESTING, OR ANY OTHER CAUSE BEYOND THE RANGE OF THE INTENDED USE, OR BY ACCIDENT, FIRE, LIGHTNING, OR OTHER HAZARD.


LIMITATIONS OF LIABILITY

UNDER NO CIRCUMSTANCES WILL ASUSTOR, ITS SERVICE PROVIDERS OR EITHER'S AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS OR AGENTS BE HELD LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR LOSS OF DATA, GOODWILL, INCONVENIENCE, DELAY, PROFITS, USE OF MONEY OR USE OF ASUSTOR PRODUCTS, INTERRUPTION IN USE OR AVAILABILITY OF DATA.

ASUSTOR'S AND THE SERVICE PROVIDER'S ENTIRE LIABILITY AND CUSTOMER'S SOLE AND EXCLUSIVE REMEDY FOR CLAIMS RELATED TO OR ARISING OUT OF THESE TERMS AND CONDITIONS FOR ANY CAUSE AND DESPITE THE FORM OF ACTION, WHETHER IN CONTRACT OR IN TORT, STATUTORY OR OTHERWISE, INCLUDING NEGLIGENCE AND STRICT LIABILITY, WILL NOT EXCEED THE AMOUNT OF THE PURCHASE PRICE PAID. THIS LIMITATION OF LIABILITY WILL BE EFFECTIVE EVEN IF CUSTOMER HAS ADVISED ASUSTOR OR ITS SERVICE PROVIDER OF THE POSSIBILITY OF ANY SUCH DAMAGES.

THESE TERMS AND CONDITIONS GIVE CUSTOMER SPECIFIC LEGAL RIGHTS. THE CUSTOMER MAY ALSO HAVE OTHER RIGHTS THAT MAY VARY FROM JURISDICTION TO JURISDICTION. THE CUSTOMER IS ADVISED TO CONSULT APPLICABLE ADMINISTRATIVE DISTRICT OR COUNTRY LAWS FOR A FULL DETERMINATION OF A CUSTOMER'S RIGHTS. SOME ADMINISTRATIVE DISTRICTS OR COUNTRIES DO NOT ALLOW A LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR CONSUMER PRODUCTS. IN SUCH ADMINISTRATIVE DISTRICTS OR COUNTRIES, SOME EXCLUSIONS OR LIMITATIONS OF THESE TERMS AND CONDITIONS MAY NOT APPLY TO CUSTOMER.
